A lot of the problem is that with Mike gone, Dalton stretched thin, and most of the senior mods absent or inactive, there's really no one keeping the staff pointed in the same direction on rules and policy. It looks like nobody is keeping the board rules updated, either (this is how Ghost Rider became an admin--he always volunteered for unglamorous stuff like that).
I kinda wish Mike would just give Dalton the keys to the place and say, "Hey, run it however you want; just don't be a fuckwit." On the other hand, I have no idea who he'd tap to be "deputy admin", other than Edi (who I know you guys don't generally like, but I always thought he was a good mod and a p. cool guy). The mod staff is getting pretty threadbare, too, and who the hell out of the general user base would you promote to mod at this point?

EDIT: I guess I forgot to answer your actual question. Yes, Dalton can ban people on his own authority, though it's not his preferred punishment. Without looking up the statistics or anything, I would guess he's banned people at a much slower rate than Mike ever did. Supermods cannot issue bans except in very obvious cases like spambots, and that is indeed the result of the DataPacRat fiasco.
