All I did was spot the random capitalization and remove spaces & dashes. I was tripped up by the chaining of two of the "terms" together for no fucking reason. I'm not willing to see how many others are just stupid terms lifted from that horrible tvtropes website. I wish it was just weeaboos as it would be easier to avoid.

the analogy holds though, because when you're dismissed as a layperson in an engineering question it's because you lack the proof of education, but judges arguably go through even tougher education than engineers (unless they are elected as i hear you sometimes do in the us) soooo

legal opinions are often expressed over hundreds of paper pages, they have to weigh tons of evidence against a thousand laws and to figure whether to follow the letter of the law or what previous rulings say etc., etc. that the layperson usually has no hope of doing thoroughly

hell i was thinking this morning how it's practically impossible to be an informed citizen of a country, because the laws make up a ten kilogram tome of bullshit (at least here) that no one can possibly remember in its entirety

of course i don't know what this specifically is about, so don't take this as commentary on anything but the general case of court rulings

but i often see people deciding what's the correct ruling in "obvious" cases as presented in the press. like recently i heard "19-year old girl charged with rape of 13-year old boy after she reported being raped by him". popular verdict: "she is a bitch whore". because obviously 13-year old boys can't possibly rape someone older under any circumstances or something

say i've heard that in countries like france the law is a lot easier to understand because it's based on what napolean wrote rather than what a million judges decided in the past

It may be easier to understand

But the whole legal system is unholy bloat with a number of laws counted in the dozen of thousands (I think there may be more than 100k of them, but don't trust my words), many of them redundant or obsolete. And the whole edifice is reminiscent of spaghetti programming. :psypop:

This is why I tend to argue in favor of a total recast of the French legal system - the problem being that it is impossible in practice for a number of reasons, and that I wouldn't trust our government(s) with such a power anyway (remaking the whole legal system from the ground up).

If only there was an option to "clean the code" like with programming... *sigh*

And anyway, it's a bigger priority these days to force the upgrade from the 5th to the 6th Republic (totally rewriting the constitution and adapting the Republic's institutions [*] to the new realities of the XXIst Century). Once this is done and only then will we have time to cut back the obsolete & redundant crap from our legal system.



[*] : almost all the people that are favorable to the idea of a 6th Republic tend to think that we should ditch the President and become a Parliamentary Republic instead (think Germany or Italy). I agree with them, and the current campaign for the 2012's Presidential elections only reinforce my opinion with each passing days : one man, even elected, cannot be trusted with such powers. What we have right now is an Elected Monarch.

yeah a monarchy is a pretty obsolete system, but a powerless ceremonial figurehead is way better than an elected king with actual powers. even powerless presidents can still call on their electorate to claim some sort of legitimate right to political influence a single person should not have

i'd say people should grow out of their stupid need for father figures
